One of the biggest changes in the 2026 standards involves how we handle offers and compensation. A common (and now very dangerous) mistake is delaying the delivery of an offer while you try to negotiate your commission.
Under the updated Standard of Practice 1-6, REALTORS® are prohibited from withholding or delaying a buyer’s or tenant’s offer just because they want to iron out a separate compensation agreement.
THE FIX: Always put your client’s interests first! Present the offer as soon as possible. If you need to negotiate commission, handle that separately and professionally without using the contract as leverage.
2. The Social Media "Personal" Pass
Think your Facebook rants or "private" Instagram stories are safe from the Code of Ethics? Think again! The 2026 update to Standard of Practice 10-5 has expanded the definition of harassment. It’s no longer just about "hate speech", it’s about any harassing conduct based on protected classes.

Article 7 has been clarified for 2026, and many agents are getting it wrong. The common mistake? Thinking you have to disclose your specific compensation arrangements to everyone in the transaction.
Actually, the 2026 update clarifies that your duty to disclose and obtain consent for compensation from more than one party applies only to your own client(s). You don't necessarily owe the other side a copy of your buyer-broker agreement unless there’s a specific legal reason beyond Article 7.
THE FIX: Communication is key, but keep it directed to the right people. Ensure your clients give you written informed consent if you are receiving compensation from multiple sources.
4. The "Quick Peek" Unauthorized Access

According to the updated Standard of Practice 16-10, when you contact an unlisted owner on behalf of a buyer, you must disclose your buyer-representative relationship and your request for compensation at the very first contact. Waiting until the showing or the offer is too late!
