The New Reality: California AB 723 Explained

For a long time, virtual staging was the "wild west." We’d throw in a digital sofa, maybe brighten the grass, and call it a day. But those days are over.

California Assembly Bill 723 requires a clear and conspicuous disclosure for any digitally altered image that changes what a buyer will actually see when they step through the front door.

If you’re adding furniture that doesn’t exist, removing nearby power lines, or "AI-painting" the walls a trendy sage green, you MUST disclose it.

The rule is simple: Would a typical buyer expect to see this when they show up?

If the answer is "no," you need a label. And not buried in the fine print. We're talking on the image itself.

Digital vs Reality

Mistake #1: The Invisible "Fix"

This is the most common trap for newer agents. You take a photo of a great listing, but there’s a massive crack in the driveway or a water stain on the ceiling. You think, "I'll just let the AI 'clean' that up to show the potential."

Stop right there.

In 2026, removing a material defect via AI without disclosure is a direct violation of both AB 723 and the NAR Code of Ethics (Article 12). You aren't just "marketing"; you're concealing.

The 2026 rules demand that these images be labeled individually. Using a global disclaimer like "some images may be virtually staged" at the bottom of a description is no longer enough.

  • For major changes, use: "Conceptual renovation rendering – actual condition differs."
  • Keep the original, unaltered photo as the primary image whenever possible.

The Solution: Treat AI output as a rough draft: never the final product. Every factual claim: square footage, permits, age of the roof, school zones: must be manually verified.
